The U.S. Court of Appeals for the District of Columbia Circuit has affirmed a previous legal ruling against the U.S. Food and Drug Administration in premium cigar regulation.ย
Theย Circuit confirms that the FDAโs regulatory actions on premium cigars were arbitrary and capricious.ย
โThis is another affirmation of FDAโs missteps regarding the regulation of premium cigars and the necessity of this lawsuit,โ Joshua Habursky, executive director of the Premium Cigar Association said in a press release. โThere are still procedural items ahead, but the biggest question on the Deeming Rule is a significant victory.โ
The PCA was among the litigants challenging the FDA’s actions.
